PERMANENT STAY PERMIT (KITAP)


Permanent Stay Permit (KITAP) is transfer of status from Temporary Stay Permit (KITAS). Requirements and procedure for Permanent Stay Permit (KITAP) depends on the current status of foreigner. Temporary Stay Permit (KITAS) holder foreigners with status working as expert and investors can apply for a Permanent Stay Permit (KITAP) after living in Indonesia for at least 5 consecutive years. As for foreigners married to Indonesian citizens, they can apply for Permanent Stay Permit (KITAP) after 2 years of marriage.


DOCUMENTS REQUIRED

A.For foreign investors and foreigners working as expert:

1.   Copy of Passport (Photo and Personal data pages with at least 18 months of validity)

2.   Original KITAS

3.   Original RPTKA

4.   Copy of IMTA (all issued in last 5 years)

5.   Copy of SKPPS/SKTT (all issued in last 5 years)

6.   Copy of KITAS (all issued in last 5 years)

7.   Passport size photographs (4X6=4 and 2X3=2 in red background)

8.  Copy of Sponsor Company Documents

    –     Akta Pendirian Perusahaan (Article of Association)

    –     PPM (Investment Board Permit)

    –     Surat Domisili (Domicile Certificate)

    –     NPWP (Tax Number)

    –     TDP (Business Registration Certificate)

    –     SK Menteri (Deed of Establishment)

    –     IUT (Permanent Business License)*

    –     Wajib Lapor (Compulsory Company Report)

9.  Copy of Identity card (KTP) of Indonesian companion (Tenaga pendamping)


B.For foreigners legally married to Indonesian citizen:

1.   Copy of Passport (Photo and Personal data pages with at least 18 months of validity)

2.   Original KITAS

3.   Copy of KITAS (all issued in last 5 years)

4.   Copy of SKPPS/SKTT (all issued in last 5 years)

5.   Passport size photographs (4X6=4 and 2X3=2 in red background)

6.   Copy of Identity card (KTP) of Indonesian spouse

7.   Copy of Family Register (Kartu Keluarga) of Indonesian spouse

8.   Copy of Marriage Certificate (Surat Nikah)

9.  Original Bank statement of Indonesian spouse with minimum balance of Rp. 10.000.000

 The Citizenship of Indonesia may be acquired through marriage with an Indonesian citizens. This is a new method provided by the new Indonesia´s 2006 Citizenship Law in acquiring a Citizenship of Indonesia. The Indonesian spouse can be the sponsor for his/her spouse to turn status to Indonesian citizen.

This article will hopefully useful for foreigners married to Indonesian spouse who are considering to relinquish his/her current citizenship  and wish to seek the possibility of becoming an Indonesian.

General Eligibility

Application for Indonesian citizenship may be forwarded by  the applicant upon meeting the following  general eligibility:   1. Applicant must legally married to an Indonesian citizen;   2. At the time of forwarding the application, the applicant has resided in Indonesian territory for at least 5 (five) consecutive years or at least 10 (ten) years non-continuously. This is prerequisite to the citizenship application;   3. The Indonesian citizenship will not caused double citizenship.

 Citizenship Proceeding

Application for citizenship should be forwarded in Indonesia in writing by the applicant using Bahasa Indonesia, on paper affixed with sufficient duty stamp and addressed to the local district office of Ministry of Law and Human Rights having jurisdiction over the applicant´s residence.

Time Frame

In accordance to the Decree of Ministry of Law and Human Rights, the Indonesian citizenship can be acquired within 6 (six) months upon receipt of completed application. The Ministry´s approval.The approved-applicant required to return his/her previous citizenship documentation to the foreign embassy in Indonesian within 14 days.

What If You´re Not Married to an Indonesian Citizen?

You need to go with naturalization process upon meeting the following requirements:

  1.    At least aged 18 (eighteen) or married.
  2.    KITAP card holder or Permanent Resident in Indonesia.
  3.    At the time of forwarding the application has resided in Indonesian territory for at least 5 (five) consecutive years or at least 10 (ten) years intermittently;
  4.    Sound in health and mind;
  5.    Able to speak Bahasa Indonesia and acknowledges the state basic principles of Pancasila and the 1945 Constitution;
  6.    Was never legally prosecuted due to acts of crime and sentenced jail for 1 (one) year or more;
  7.    Upon acquiring Indonesian Citizenship will relinquish any other citizenship;
  8.    Employed and/or has a steady income, and
  9.    Pay a naturalization fee to the Government Treasury.


Application for naturalization should be forwarded in Indonesia in writing by the applicant using Bahasa Indonesia, on paper affixed with sufficient duty stamp and addressed to the President of the Republic of Indonesia through the Minister of Law and Human Rights.

Copies of the Presidential Decree on naturalization and report on the declaration of allegiance ceremony becomes legal proof of Indonesian citizenship for a person who has been granted citizenship.









Working permit visa / KITAS

For foreigners who want to stay and work in Indonesia 

You will need a sponsorship from an Indonesian based company.

The company sponsored you needs to supply the following documents to process KITAS :

  • Copy of company’s act

  • Copy of the company’s locality letter (SKTU)

  • Copy of the company’s tax number (NPWP)

  • Copy of the company’s business license letter (SIUP)

  • Organization Structure

  • Copy of the employee contract (for companies employing foreigner)

  • Copy of the director’s identity card

  • Copy of the report to the labor department adapted by UU no. 17, 1981

  • 15/20 company letter heads, signed by the company director and sealed with the company stamp

  • Copy of the KTP of an Indonesian work colleague

Foreign applicants papers needed to process KITAS :
  • copy of the foreigner’s passport
  • Curriculum Vitae and references
  • Passport sized photographs with red backgrounds (4 X 6 = 10 pieces, 3 X 4 = 5 pieces, 2 X 3 = 5 pieces)

If you want to take your family with you, we need for processing the KITAS :

  • Copy of the wife’s and children’s passport
  • Copy of the marriage certificate
  • Copy of the children’s birth certificate
  • Passport sized photograph (4 X 6 = 8 pieces, 3 X 4 = 5 pieces, 2 X 3 = 5 pieces)
  • Copy of the family register

Procedure :


When we have received your documents we will start to process. The above documents need to be sending to Jakarta for approval. If your application is approved you will receiving a telex visa, this process can take up 30 days before a decision is made and the visa granted. When the telex visa is issued you can apply for the real visa at the Indonesia embassy or consulate overseas, nearest to you. You need to pay in local currencies for the visa application and the duration of the visa process in the country where you apply for the visa is depending on the embassy / consulate.

When you get your visa, you must return to Indonesia and then report to Immigration maximum 7 days within the arrival date. We can do all this for you and guide you in processing.


The process can take up within 30 days in Immigration offices. When finished you will receive the following documents:

1) KITAS, limited stay permit card 
2) Blue Book, control book from Immigration 
3) Yellow Book, certificate from the police 
4) STM, report certificate from the police 
5) IMTA, working permit

The above documents are valid for one year and you will need to pay USD 1200 to the government.

What if I need to go overseas?

You must apply exit re-entry permit in Immigration and paying fiscal duties directly at the airport; Rp. 1.000.000,-

We also can handle this for you, this process can take up to two days. 
There are:
  • Single exit re-entry permit valid for 3 months you can use only once
  • Multiple exit re-entry permit valid for 6 months you can use for many times within 6 months
  • Exit permits only, EPO. Only to process if you want to stop your KITAS

Making an ERP / MERP

ERP / MERP stands for (Multiple) Exit Re-Entry Permit, is a permit to someone who have a KITAS (Kartu Ijin Tinggal Terbatas (Limited Stay Permit)) want to leave Indonesia and then come back again.

There are 4 (four) types of ERP/MERP:

  1. Single ERP for 3 month, which is valid only for 3 month, and only for single leaving then coming back again to Indonesia. 
  2. MERP for 6 month, which is valid for 6 month, and can be used for multiple leaving and coming back to Indonesia.
  3. MERP for 1 year, which is valid for 1 year, and can be used for multiple leaving and coming back to Indonesia. 
  4. MERP for 2 years, which is valid for 2 years, and same with other MERP above. (for KITAP holdre only)

This permit should apply in the Immigration Office in Yogyakarta, ten (10) days before departure. Before that, a recommendation letter should be made from UGM. The following are documents should prepare:
  1. A letter of recommendation issued by the Office of International Affairs (KUI UGM). Request this letter by filling the form in International Office and Student Service (IOSS). 
  2. Application forms
  3. A copy of a valid passport
